Fraud Warning 

Any person who knowingly and with intent to defraud any insurance company or other person files an application for insurance or statement of claim containing any materially false information, or conceals for the purpose of misleading, information concerning any fact material thereto, commits a fraudulent insurance act, which is a crime, and shall also be subject to a civil penalty not to exceed five thousand dollars and the stated value of the claim for each such violation.

Credit Disclosure

In connection with this application for insurance, we may review the unit owner’s credit report or obtain or use a credit-based insurance score based on information contained in that report. An insurance score uses information from the credit report to help predict how often you are likely to file claims and how expensive those claims will be. Typical items from a credit report that could affect a score include, but are not limited to, the following: payment history, number of revolving accounts, number of new accounts, the presence of collection accounts, bankruptcies and foreclosures. The information used to develop the insurance score comes from the following consumer reporting agencies: Experian, TransUnion, or Equifax. Future reports may be used to update or renew your insurance.

This email address will be used to send you emails about your quote. We respect customer privacy and do not sell email addresses. You can opt-out at any time.

Automatic Renewal

By purchasing a policy you agree to be bound by the terms and conditions of the Automatic Payments Agreement below. You further agree that the policy will renew annually until canceled by you. You will receive emailed premium notices and confirmations of your payments. It is your responsibility to keep your email address current.

Oyster or Oyster’s partners and affiliates will not be responsible for any payment processing errors or fees incurred if you do not provide accurate account, contact or other required information.

If funds are not available when we attempt to process your payment, or if the payment is declined, we reserve the right to deactivate your Automatic Payments account, however you will continue to be responsible for paying your premium by the due date. You may activate, or deactivate Automatic Payments at any time by accessing your Automatic Payment enrollment online through the online Oyster dashboard or by contacting support at support@withoyster.com. Your policy will renew automatically each year and the recurring payment schedule will continue as long as this policy remains in force and will be used for all subsequent policy renewals, modifications, and endorsements associated with your account. If you do not wish to renew, you can cancel policy renewal in the Oyster dashboard.

Electronics Communications

You consent to receive by electronic means, to the extent permitted by law, your insurance policy, forms, documents, and records related to your insurance policy, various notices (including, without limitation, privacy notices), disclosure documents, and communications from us relating to policies that you have applied for and/or will buy from us or have bought from us, and other materials regarding our insurance products (which may include, but not be limited to, other materials which we are, or may be, legally required to deliver to you), contracts and amendments to contracts, and other information which you will have the opportunity to electronically review, receive, complete and sign, as applicable. Verification of Content

You declare that the statements contained herein are true to the best of your knowledge and belief and do agree to pay any surcharges applicable under the Company rules which are necessitated by inaccurate statements. You declare that no persons other than those listed in this application regularly wear or use the described items in this application. You understand that this policy may be canceled, rescinded, or declared void and coverage may be denied for an accident or loss if this application contains any false or fraudulent representations that are material to the risk insured hereunder and that, if the true facts were known to the Company, it would have refused to issue the policy or required the policy to be issued with limitations. I acknowledge that insurance prices may vary based on how I buy (e.g. mobile, tablet, phone, agent, etc.).

Notice of Information Practices

You understand that to calculate an accurate price for your insurance, the Company may obtain information from third parties, such as consumer reporting agencies that provide driving, claims, insurance, vehicle, property, and credit histories. You understand that this information could result in a policy declination, cancellation, or nonrenewal. The Company may use a credit-based insurance score based on the information contained in the credit history. The Company or its affiliates may obtain new or updated information to calculate your renewal premium or service your insurance. You may access information about me and correct it if inaccurate. In some cases, the law permits and sometimes requires the Company to disclose the information it collects without authorization. However, the Company will not share personal information with nonaffiliated companies for their marketing purposes without consent. Complete details are in the Company's Privacy Policy.

The Company may obtain information from third parties. You understand that this information may affect your policy premium or could result in a policy declination, cancellation, or nonrenewal.


Payment Procedures

By submitting payment information for an accepted method of payment (“Payment Method”) through the Company’s services, you authorize the Company to charge the agreed upon amounts to your Payment Method. You understand that you may choose a credit or debit card as a Payment Method to pay for charges and fees in connection with the Company’s services. Should you choose to do so, you warrant that you have signature authority to this account and am authorized to use such credit or debit card for this purpose. You understand that should I use a credit or debit card without authorization, in whole or in part, you will remain responsible for any outstanding balance, and that the Company may alert the appropriate authorities of your misuse. By submitting your private information electronically, I am acknowledging that the Company assumes no liability for data submitted via this platform.

If You make your initial payment by credit card or debit card, the coverage afforded under this policy is conditioned on payment to the Company by the card issuer or financial institution. You understand that if the Company is unable to collect your initial payment, the Company shall be deemed not to have accepted the payment and this policy shall be voided. You also understand that if you authorize a credit card or debit card transaction for any payment other than the initial payment, this policy will be subject to cancellation for nonpayment of premium if the Company is unable to collect payment from the card issuer or financial institution. The Company is deemed "unable to collect" in the following instances: (1) when you reach my credit limit on my credit card and the card issuer refuses the charge; (2) when the card issuer cancels or revokes my credit card; or (3) when the card issuer does not pay the Company, for any reason whatsoever, upon the Company's request.

You authorize the Company to charge your credit or debit card for amounts you owe under the policy. If your credit or debit card is rejected or a charge is unpaid for any reason, you authorize the Company to resubmit it for payment one or more additional times. You understand that at all times you must provide a valid card for payment of amounts you owe. If you do not, or if any charge is invalid for any reason, you understand that the Company may suspend or cancel the policy. This authorization will remain in effect until the policy is terminated and all amounts you owe are paid. That means that the Company may charge or debit your account for amounts you owe under the Policy even after the Policy is canceled, non-renewed or otherwise terminated. If you choose to cancel the recurring charges, and therefore the policy, you may do so by contacting the Company by emailing support@withoyster.com.

If you cancel your policy, the Company will stop your future payments as of the date my policy is canceled. The Company will charge your Payment Method for any outstanding charges due. As used in this Insurance Application, “billing” shall indicate a charge, debit, or other payment clearance, as applicable, against your Payment Method. You may edit your Payment Method information in the Oyster Dashboard. If a payment is not successfully settled, due to expiration, insufficient funds, or otherwise, and you do not edit your Payment Method information or cancel your account prior to your next payment due, you remain responsible for any uncollected amounts, including any additional fees and authorize the Company to continue billing the Payment Method, as it may be updated. This may result in a change to your payment billing dates. You understand that this authorization will remain in effect including for any renewal terms. You agree not to dispute these scheduled payments with your bank or credit card provider so long as the transaction corresponds to the terms indicated in this authorization.
